These Terms & Conditions (“Terms”) govern your access to and use of www.yourothermind.co (the “Website”) and certain products, resources, memberships, events, accounts, and services offered through the Website by Your Other Mind, LLC (“Your Other Mind,” “YOM,” “we,” “us,” or “our”).
By accessing the Website, creating an account, making a purchase, registering for an event, or otherwise using our Website or services, you agree to these Terms.
If you do not agree to these Terms, do not use the Website.
1. Eligibility
You must be at least 18 years old to purchase Your Other Mind products or services, create a client account, participate in a membership, or enter into a service relationship with Your Other Mind.
By using our paid services, you represent that you are at least 18 years old and legally capable of entering into a binding agreement.
2. Our Services
Your Other Mind provides business consulting, strategy, founder development, education, assessments, memberships, resources, events, masterclasses, experiences, and related services.
Services may include proprietary frameworks and methodologies developed by Your Other Mind, including Founder OS™, Business OS™, Profitable Freedom Framework™, 90-Day Sprints, and other methodologies, assessments, systems, tools, and programs.
Offerings may change from time to time.
Descriptions on the Website are provided for general informational purposes. The specific scope, duration, deliverables, payment obligations, and terms of a consulting or client engagement may be governed by a separate agreement.
3. Separate Client Agreements Control
Certain Your Other Mind services require clients to enter into a separate service agreement, partnership agreement, program agreement, purchase agreement, or other contract before services begin.
These Website Terms do not replace those agreements.
If a provision of a properly executed individual client agreement conflicts with these Website Terms regarding the services governed by that agreement, the individual agreement will control to the extent of that conflict.
4. Accounts and Client Portals
Certain services may require you to create an account or use a client portal.
You agree to provide accurate information and maintain the security of your account credentials.
You are responsible for activity occurring through your account to the extent permitted by law.
Client portals may be used to:
- Access resources
- Upload documents
- Submit information
- Communicate with our team
- Receive deliverables
- Participate in programs
- Manage aspects of your account
When your client relationship ends, Your Other Mind may terminate access to your portal and account.
Where appropriate, client-owned files may be transferred to you.
Your Other Mind is not required to transfer proprietary tools, frameworks, prompts, templates, internal documents, AI systems, methodologies, processes, or other YOM intellectual property simply because they were used during your engagement.
5. Purchases and Payments
Prices are displayed at the time of purchase or otherwise communicated through an applicable service agreement, invoice, proposal, or checkout page.
Payments may be processed through third-party payment providers, including Stripe and Ivorey.
By submitting payment information, you represent that you are authorized to use the payment method provided.
You agree to pay all fees associated with your purchase according to the applicable checkout terms or client agreement.
6. Refund Policy
Except where expressly stated otherwise in a written agreement or where required by applicable law, purchases from Your Other Mind are final and non-refundable.
Specific consulting engagements, programs, and partnerships may have additional cancellation, payment, refund, or termination provisions contained in their individual agreements. Those provisions control the applicable engagement.
Failure to attend, participate in, access, or fully use a purchased product or service does not automatically entitle you to a refund.
7. Creators Collective Membership
The Creators Collective is a recurring membership.
Membership may be canceled at any time through the applicable client/member portal or by submitting a cancellation request through the available support channel.
Cancellation stops future recurring charges.
All amounts already paid are non-refundable, and no prorated refunds are provided.
When cancellation becomes effective, access to the Creators Collective terminates immediately.
By canceling, you acknowledge that you may lose access to membership resources, community spaces, materials, and benefits immediately upon cancellation.
8. Events
Unless otherwise stated at purchase, ordinary event tickets are non-refundable.
Ordinary event tickets may be transferred to another eligible attendee, subject to any registration requirements or event-specific restrictions communicated by Your Other Mind.
Your Other Mind may require advance notice of a ticket transfer.
9. Retreats and Experiences
Payments made toward retreats, immersive experiences, destination experiences, or other offerings specifically identified as experiences are non-refundable and non-transferable, except where otherwise required by law or expressly stated in a written agreement.
This includes deposits, installment payments, and full payments.
Because Your Other Mind may make financial commitments based upon registration—including venue, accommodation, staffing, vendor, travel, programming, or other costs—your inability or decision not to attend does not create a right to a refund or transfer.
Additional retreat or experience terms may apply and will be disclosed through the applicable registration or participant agreement.
10. Intellectual Property
The Website and Your Other Mind's services contain proprietary intellectual property owned by or licensed to Your Other Mind.
This includes, without limitation:

- Business OS™
- Profitable Freedom Framework™
- Assessments
- Frameworks
- Methodologies
- Processes
- Systems
- Prompts
- AI systems and workflows
- Templates
- Worksheets
- Reports and report structures
- Training materials
- Educational content
- Videos
- Masterclasses
- Presentations
- Business tools
- Graphics
- Written content
- Program structures
- Internal operating methodologies
Unless expressly authorized in writing, purchasing or participating in a Your Other Mind service grants you only the limited right to personally use materials provided to you for their intended purpose.
It does not transfer ownership of Your Other Mind intellectual property.
11. Prohibited Uses of Our Intellectual Property
Without prior written permission from Your Other Mind, you may not:
- Copy or reproduce our proprietary materials for commercial use
- Resell our materials
- License or sublicense our materials
- Republish our proprietary materials
- Create substantially derivative commercial products from our proprietary systems or frameworks
- Teach or distribute our proprietary methodology as your own
- Remove ownership, copyright, trademark, or proprietary notices
- Upload proprietary YOM materials, frameworks, assessments, reports, prompts, templates, or methodologies into third-party artificial intelligence systems for the purpose of replicating, reverse engineering, extracting, commercializing, or reproducing our systems
- Use our materials to train or develop an AI model, chatbot, assessment system, consulting methodology, or competing product
- Reverse engineer our proprietary AI workflows, assessments, methodologies, or systems
- Represent Your Other Mind intellectual property as your own
Nothing in these Terms prevents a client from using the knowledge, recommendations, strategies, or client-specific information they legitimately receive in operating their own business, subject to their applicable client agreement.
12. Your Materials
You retain ownership of original information, documents, data, and materials you provide to Your Other Mind.
By providing those materials to us, you authorize Your Other Mind to access, analyze, reproduce, process, and otherwise use them as reasonably necessary to perform the services you requested.
This authorization does not transfer ownership of your underlying materials to Your Other Mind.
However, Your Other Mind retains ownership of its methodologies, systems, frameworks, processes, prompts, tools, templates, assessments, AI systems, and other intellectual property used to analyze your materials or produce services and deliverables.
A client-specific deliverable does not transfer ownership of the underlying YOM system or methodology used to create it unless a written agreement expressly states otherwise.
13. Artificial Intelligence
Your Other Mind may use internally managed or proprietary artificial intelligence tools to support assessments, analysis, service delivery, reporting, strategy development, and internal workflows.
AI-assisted information is not intended to replace the professional judgment of the Your Other Mind team or licensed professionals where professional services are required.
You may not attempt to access, reproduce, reverse engineer, extract, copy, or commercialize Your Other Mind's underlying AI prompts, systems, workflows, methodologies, or proprietary technology.
14. No Guarantee of Results
Your Other Mind provides strategy, consulting, recommendations, systems, education, implementation support, and related services intended to help founders and businesses improve their operations, profitability, growth, leadership, and business performance.
Business outcomes depend upon numerous factors outside Your Other Mind's control.
Your results may depend upon factors including your:
- Implementation
- Decisions
- Execution
- Business model
- Market
- Customers
- Pricing
- Team
- Financial circumstances
- Timing
- Economic conditions
- Consistency
- Willingness and ability to implement recommendations
Accordingly, Your Other Mind does not guarantee any particular revenue, profit, sales, business growth, funding, customer acquisition, business valuation, personal outcome, or other result.
Testimonials, case studies, examples, projections, estimates, and descriptions of previous client outcomes are illustrative and are not guarantees that you will achieve the same or similar results.
15. No Professional Advice
Your Other Mind provides business consulting, strategy, founder development, education, and related services.
Unless expressly provided through an appropriately licensed professional under a separate engagement, information provided through Your Other Mind does not constitute:
- Legal advice
- Tax advice
- Accounting advice
- Investment or financial advisory services
- Medical advice
- Mental health treatment or psychotherapy
You should consult an appropriately qualified and licensed professional regarding matters requiring specialized professional advice.
Any spiritual, energetic, Human Design, Gene Keys, founder-development, reflective, or similar material incorporated into our services is provided as part of our educational, strategic, or developmental methodology and is not a substitute for medical or mental-health diagnosis or treatment.
16. Decisions and Implementation
You remain responsible for your business decisions.
Your Other Mind may provide recommendations, strategies, implementation support, analyses, frameworks, or perspectives, but you are responsible for determining whether and how to implement them.
You remain responsible for obtaining appropriate legal, financial, accounting, tax, employment, regulatory, or other professional advice relevant to your business.
17. Communications
By providing contact information and consenting to communications, you may receive service-related communications from Your Other Mind through email, telephone, SMS, client portals, or other communication platforms.
Where you have consented to marketing communications, you may also receive information about Your Other Mind programs, events, services, resources, and offers.
You may opt out of marketing SMS messages by replying STOP.
Message and data rates may apply.
Marketing consent is not a condition of purchasing services unless expressly permitted by applicable law.
18. Third-Party Services
Your Other Mind may use or integrate third-party services such as payment processors, client management platforms, scheduling systems, communication platforms, and other technology providers.
Your use of third-party platforms may also be governed by those providers' terms and privacy policies.
Your Other Mind is not responsible for outages, security failures, policy changes, acts, omissions, or services controlled exclusively by independent third-party providers, except to the extent liability cannot legally be excluded.
19. Acceptable Use
You agree not to use our Website, accounts, portals, communities, or services to:
- Violate applicable law
- Infringe another person's rights
- Gain unauthorized access to accounts or systems
- Introduce malware or harmful technology
- Harvest information from other users

- Misappropriate Your Other Mind intellectual property

Your Other Mind may suspend or terminate Website, portal, membership, community, or service access when reasonably necessary because of:
- Nonpayment
- Material violation of these Terms
- Violation of an applicable client agreement
- Fraud
- Abuse
- Harassment
- Security concerns
- Intellectual-property infringement
- Unlawful activity
Termination does not automatically create a right to a refund.
Separate client agreements may contain additional termination provisions.
21. Website Availability
We strive to maintain reliable access to our Website and digital services but do not guarantee uninterrupted or error-free operation.
We may modify, suspend, maintain, update, or discontinue Website features when reasonably necessary.
22. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Website, general Website content, and resources are provided on an “as is” and “as available” basis.
Your Other Mind does not warrant that the Website will always be uninterrupted, error-free, secure, or free from harmful components.
Nothing in this provision eliminates warranties or rights that cannot legally be waived.
23. Limitation of Liability
To the fullest extent permitted by applicable law, Your Other Mind, LLC and its owners, officers, employees, contractors, representatives, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Website or services, including loss of profits, revenue, business opportunities, data, or goodwill.
To the fullest extent permitted by applicable law, Your Other Mind's aggregate liability arising from a Website purchase or service will not exceed the amount actually paid by you to Your Other Mind for the specific product or service giving rise to the claim during the applicable period established by law or any controlling written agreement.
This limitation does not apply where liability cannot legally be limited or excluded.
A separate client agreement may establish additional or different liability provisions for services governed by that agreement.
24. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Your Other Mind, LLC and its owners, officers, employees, contractors, representatives, and affiliates from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Website, your material violation of these Terms, your infringement of another party's rights, or materials you provide that unlawfully infringe third-party rights.
25. Dispute Resolution
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
Before initiating formal proceedings, you and Your Other Mind agree to make a good-faith attempt to resolve a dispute directly.
If the dispute cannot be resolved informally, the parties agree to attempt mediation in Georgia before proceeding to binding arbitration.
If mediation does not resolve the dispute, the dispute will, to the extent permitted by law, be resolved through binding arbitration in Georgia rather than litigation before a judge or jury.
The parties may use a mutually agreed arbitration provider and arbitrator.
Nothing in this provision prevents either party from seeking temporary or preliminary injunctive relief, pursuing qualifying intellectual-property remedies, enforcing an arbitration award, or bringing a matter in a court where arbitration is prohibited or otherwise unavailable under applicable law.
Any court proceeding permitted under this section shall be brought in a court of competent jurisdiction in Georgia, and the parties consent to jurisdiction and venue there to the extent permitted by law.
26. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
27. No Waiver
Failure by Your Other Mind to enforce a provision of these Terms does not waive our right to enforce that provision later.
28. Changes to These Terms
Your Other Mind may update these Terms periodically to reflect changes to our business, Website, offerings, technology, or legal obligations.
The “Last Updated” date will identify the most recent revision.
Your continued use of the Website after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
Material changes affecting an existing contracted client relationship will remain subject to any controlling client agreement.
29. Entire Website Agreement
These Terms, together with our Privacy Policy and any terms presented at checkout, constitute the agreement governing general use of the Website.
Separate executed client agreements, membership agreements, event agreements, retreat agreements, or other contracts may impose additional terms.
Where an applicable executed agreement expressly conflicts with these Website Terms concerning the services governed by that agreement, the executed agreement controls.
